不知所謂的日出康城車場管理

各位街坊好,小弟正是首都2座的住戶及停車場2/F,L25之用戶,事情係今年年頭一月份,因為發現汽車上出現車位既水管滴下銹水,當時正直有管理員巡邏中,小弟已第一時間話比管理員知,果位管理員望到車位上既水管不斷滴水,只同我講"哎...將軍澳係咁架啦,濕氣重,遲D可能會好D既,你不如留底聯絡電話比我,我叫有關同事覆返你啦~"因為當時已經係深夜,所以我留底聯絡電話比管理員就走左,但結果我一直都無收過任可電話!直到二月份過年前一晚,小弟又發現車輛上再次出現銹水,今次既銹水印已經乾左,出現左D白色印係車身上,範圍包括車頭,車頂以及車尾,小弟第一時間駛往L1閘口,搵管理員理論,當時管理員影相做REFENCE,安排左L1既時租位比本人暫時停泊以及叫左個清潔阿姐黎嘗試幫我洗去車上既水印,可惜都洗唔去,當時係無方法之下,只好第二日早上將車輛駛往車房比左$2000人地洗,但洗完後只要近睇車身上仍然不難發現水印,當時管理處既朱生開始聯絡本人,只承諾待龍曆新年過後會如何維修車位上既水管,以及安排小弟暫時停泊L1(停泊L1成個幾月,多次出現被外來時租車輛停泊左我個臨時位或者係果D時租車停泊係我架車前,咁我點出車呀?)同埋話幫我轉介保險申索,直到三月份,有間Cunnungham Lindsey公司既許生聯絡我,話收到首都轉介保險申索,就問我有關所發生既過程,又要我白紙黑字e-mail成個過程比佢,又話會安排同事過黎幫我架車影相做証,結果一直都無約到我,到上星期,我打電話比哩個許生,問佢依家搞成點,佢話個報告已經完成左,仲send左返首都管理處,依家等管理處覆賠定唔賠,又話幫我再追下首都果邊,結果又係無覆過我,直到今日我發現哩個許生竟然係七月九號,寄左封信比我話:
It was reported that the top, front windscreen and bonnet of the vehicle were stained during the time when the vehicle was parked in the capitoned parking space. Upon our enquiries, it is believed that the stain damage to the vehicle is attributable to condensation water that dripped from the surface of the water pipe immediately above the parking space as a result of high humidity. Upon receipt of your letter dated 28 April 2010, we conducted further enquiries with MTRC and were advised that no previous similar complaint had been received by MTRC in regard to the captioned parking space.
Based on the lack of cogent evidenced by you or otherwise, the stain damage to the vehicle was in no way causally related to any negligence on the part of MTRC in this incudent.
The User shall park his or her vehicle and use the Car Park at his or her own risk. Neither the Guest Services Centre nor its Agents shall in any circumstances be liable to the User or any other person whomsoever in respect of any loss or injury to property or person sustained by the User or any other person in the Car Park including but not limited to or theft of the User's vehicle or anything therein or thereof.
Hence,we do not consider that our Principals'Insured is legally liable in this case. Your claim is hereby denied. We suggest that you report the loss to your own vehicle insurers for their direct assistance.

咁我想問下,我地依家果d車位係固定既,我無得泊第二度,我點知個車位會滴銹水,第一次發現後,出左聲無人理,到之後嚴重到成車到係銹水積,我要比錢人地洗都唔可以100%洗得到,依家又話哩d問題唔係MTRC既責任,又唔係管理處既責任,唔通係我地D用戶既責任?唔通我叫條水管滴銹水架?咁如果我L25唔停泊車輛,我企埋去如果比D銹水滴到而受傷,係咪又唔關你地事?我只可以CLAIM自己保險?如果我無購買意外保險,咁我係咪叫抵死?同埋你地購買既保險包D咩?你地咁多管理員同CCTV用黎做咩?你地收我地咁貴既管理費,請問管理左D咩?

一定要爭取到底呀!咁大間mtr, 點可以不付責任!!!

而家係車場既水管滴銹水,唔到車塲推卸責任!哩類case係香港唔算罕見,但咁大個屋苑收咁貴管理費,可以乜都唔理,就第一次見!

每個車位每月都要交$450管理費, 用戶當然期望享用 a decent parking facility, 滴銹水一定不能接受, 請問現在 MTRC 是否已改善了水管滴水的問題?

現在保險公司拒賠, 惟有繼續和 MTRC 交涉, 希望 MTRC 都有誠意解決事件?

大陸有些露天的停車場,如果你泊架車入去裏面,跟住架車有任何損毀,停車場管理的單位都要負責。點解一間咁大既管理公司都會用一些如此理由去卸責。一定要取回公道。

每個車位每月都要交$450管理費, 用戶當然期望享用 a decent parking facility, 滴銹水一定不能接受, 請問現在 MTRC 是否已改善了水管滴水的問題?

現在保險公司拒賠, 惟有繼續和 MTRC 交涉, 希望 MTRC 都有誠意解 ...
